These Terms govern your access to and use of Kutmo (the "Service"), a browser-based video motion and silence detection tool available at kutmo.com. The Service is operated by CryptSky LLC, a Delaware limited liability company ("Kutmo", "we", "us"). By using the Service you agree to these Terms.
1. The service
Kutmo lets you analyze a video file in your own browser to detect motion and silence, and export the results to non-linear editor (NLE) project formats and a trimmed MP4. All analysis happens client-side on your device. We do not upload, store, or process your source video on our servers.
2. Eligibility and accounts
You must be at least 16 years old (or the age of digital consent in your jurisdiction) and capable of entering a binding contract to use the Service. Some features require an account. You sign in with your Google or Microsoft account and are responsible for keeping that account secure. Notify us at support@kutmo.com if you believe your account has been used without authorization.
3. Free use and Kutmo Pro
Kutmo places no limit on the length of the videos you analyze. The first 2 detection runs need no account and are metered in your browser's local storage; a free account adds 5 further runs, metered per account. Exporting a completed run is not itself metered. Kutmo Pro removes the run limit and is billed monthly ($4.99 USD) or yearly ($49 USD), at the rate shown at checkout. Pricing may change for future renewals; we will notify you in advance.
All Pro charges are processed by Stripe, our payment processor. Kutmo is the seller and merchant of record. Stripe's Terms apply to the payment processing, in addition to these Terms.
4. Cancellation
You may cancel a Pro subscription at any time from the subscription page or by emailing us. Cancellation takes effect at the end of the current paid period; you keep Pro access until that date and are not charged again.
5. Refunds
See our refund policy. In short: 14-day no-questions-asked refund on the most recent payment.
6. Acceptable use
You agree not to:
- Use the Service to process content you do not have rights to analyze or modify.
- Reverse-engineer, scrape, or rehost the Service to create a competing product.
- Attempt to bypass plan limits, payment, or authentication.
- Use the Service to violate the law, infringe intellectual property, or harm others.
- Submit content that is illegal in the jurisdiction where you operate.
We may suspend or terminate accounts that violate these rules.
7. Your content
You retain all rights to videos and project files you process with Kutmo. Because analysis happens in your browser, we never receive a copy of your source content. Exported XML and MP4 files belong to you.
8. Our intellectual property
The Service — including its software, design, wordmark, and documentation — is owned by Kutmo and protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service as permitted by these Terms and your plan. No other rights are granted. Feedback you send us may be used to improve the Service without obligation to you.
9. Service availability
We aim for high availability but do not guarantee uninterrupted service. The Service is provided "as is", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Browser compatibility, codec support, and the correctness of detected cuts depend on your device, the source file, and your settings.
10. Limitation of liability
To the maximum extent permitted by law, Kutmo's total liability for any claim arising out of these Terms or the Service is limited to the greater of the amount you paid for the Service in the 12 months preceding the event giving rise to the claim, or USD $50. We are not liable for indirect, incidental, consequential, or special damages, including lost profits or data. Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud, gross negligence, or mandatory consumer rights.
11. Indemnification
You will indemnify and hold Kutmo harmless from claims, damages, and reasonable costs (including legal fees) arising from your content, your violation of these Terms, or your violation of any law or third-party right in connection with your use of the Service. This does not apply where prohibited by mandatory consumer law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms. Sections that by their nature survive termination (acceptable use, your content, limitation of liability, dispute resolution) survive.
13. Changes to the terms
We may update these Terms from time to time. Material changes will be announced on this page or by email at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Disputes arising out of these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction — except that if you are a consumer in a jurisdiction whose mandatory law grants you the right to bring or defend claims in your local courts under your local law, nothing in this section takes that right away. Before filing any claim, you agree to first contact us at support@kutmo.com and give us 30 days to try to resolve the dispute informally.
15. General
These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and Kutmo regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of the Service, with notice to you.
